General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (“GTC”) govern all coaching and education services provided by Rod Thomas (“the Coach”), to its clients (“the Client”).
By booking or using coaching services, the Client confirms that they have read, understood, and accepted these GTC.

2. Nature of the Services

Coaching is a collaborative and goal-oriented process designed to support the Client in personal and/or professional development.

Workshops are hands-on, interactive learning session where people actively practice a skill or work on a real problem.

Speeches are structured talks designed to inform, inspire, or reframe how people think.

Our services:

  • Are not part of a therapy, counseling, medical treatment, or legal advice
  • Does not replace professional medical, psychological, legal, or financial services
  • Are based on self-reflection, awareness, and action initiated by the Clien

The Coach/Trainer does not guarantee specific outcomes or results.

3. Client Responsibility

The Client acknowledges that:

  • They are fully responsible for their own decisions, actions, and results
  • Coaching success depends on their motivation, engagement, and implementation
  • They remain solely responsible for their physical, mental, and emotional well-being during and after coaching sessions

4. Coach Responsibility

The Coach commits to:

  • Providing coaching services with professionalism, care, and integrity
  • Respecting the Client’s autonomy, values, and objectives
  • Maintaining confidentiality in accordance with Section 8 of these GTC

The Coach is bound by a best-effort obligation, not a results obligation.

5. Services and Fees

The scope, format (online/in-person), duration, and fees of coaching services are defined in:

  • The service description on the website, and/or
  • A written agreement, offer, or confirmation

Customized training and coaching are possible upon request. All prices are stated in Swiss francs (CHF) and exclude applicable taxes, unless otherwise specified.

6. Payment Terms

Unless otherwise agreed:

  • Payment is due in advance upon receipt of the of the invoice
  • Coaching sessions may be suspended in case of late or non-payment
  • Fees already paid are non-refundable

7. Cancellation and Rescheduling

  • Sessions may be rescheduled or canceled free of charge up to 48 hours before the scheduled time
  • Late cancellations or no-shows will be charged in full
  • The Coach reserves the right to reschedule sessions due to exceptional circumstances

8. Confidentiality

Both parties agree to keep strictly confidential all personal, professional, and sensitive information exchanged during coaching sessions.
Confidentiality does not apply where disclosure is required by law or where there is a risk of serious harm to the Client or others.

9. Data Protection

We take the protection of your personal data seriously and process your data in accordance with the Swiss Federal Act on Data Protection (FADP).

Client data is used solely for:

  • Delivering coaching services
  • Administrative and accounting purposes
  • Legal obligations

10. Intellectual Property

All coaching materials, documents, exercises, and content provided by the Coach remain the intellectual property of the Coach.
The Client may not reproduce, distribute, or use these materials for commercial purposes without prior written consent.
Any unauthorized use, reproduction, or distribution of these materials constitutes a violation of intellectual property rights and may result in legal action being taken to protect those rights.

11. Termination

Either party may terminate the coaching relationship only for serious reasons. A serious reason may include a material breach of the coaching agreement, failure to act in good faith, abusive behaviour or circumstances that make continuation of the coaching relationship unreasonable. Termination must be provided in writing.
Fees for sessions already delivered, as well as sessions cancelled late, remain due and non-refundable.

12. Force Majeure

Neither party shall be held liable for failure to perform obligations due to events beyond reasonable control (e.g. illness, natural disasters, technical failures).

13. Governing Law and Jurisdiction

These General Terms and Conditions (GTC) are governed by the laws of Switzerland, in particular the Swiss Code of Obligations and the Swiss Federal Act on Data Protection.
Any dispute arising from or in connection with these GTC shall fall under the exclusive jurisdiction of the competent courts of the canton of Vaud, unless mandatory law provides otherwise.

14. Amendments

The Coach reserves the right to amend these GTC at any time. The version in force at the time of booking applies.
